What are Patent Appeals?

If you are unable to reach agreement with the Patent Examiner during the patent application process, and after the Examiner twice rejects your claims, it is possible to seek review of the Examiner’s opinion by filing a Notice of Appeal with the Patent Trial and Appeal Board (PTAB). This is a specialized proceeding where a Notice of Appeal is filed and the matter is reviewed by a panel of three members who review the Examiner’s position and make a determination.
