Legal Background

Kenneth L. Sherman is the founder and Managing Partner of SHERMAN IP. He is responsible for creating, organizing and overseeing each of the practice areas in which SHERMAN IP practices. Ken was admitted to the Bars of the States of New York (1988), New Jersey (1988), and California (1991) and is registered to practice before the United States Patent and Trademark Office (1989).

Education

Ken received his Bachelor of Science degree in Electrical Engineering from the University of Southern California in 1985, where he was the recipient of numerous academic scholarships. While at USC Ken was an Undergraduate Research Fellow with USC’s Optical Materials and Devices Laboratory, where he conducted scientific research into such technologies as optics, image processing, computer modeling, thin film sputter deposition, ion implantation, and liquid crystal devices.

In 1988, Ken received his Juris Doctorate from The George Washington University’s National Law Center in Washington, D.C. Upon being admitted to the bar, Ken practiced law in New York City until moving to California in 1990.

Legal Expertise

Ken is a specialist in intellectual property issues including patent prosecution, trademark prosecution, litigation and controversy matters surrounding intellectual property protection, negotiation and drafting contracts for corporate technology transactions and creation of strategies for the development of new technologies. Ken’s patent prosecution experience includes such technologies as digital electronics, signal processing of optical, audio and electronic signals, radar systems, optics, microprocessor systems, video systems, medical imaging systems, materials development, robotics, microwave, laser testing systems, feedback systems, loudspeaker systems, telecommunications, computer/digital networks, systems architectures, and power supplies. Ken is himself an inventor listed on several patents and patent applications.

Ken is an experienced litigator in patent, trademark, trade secret, unfair competition, entertainment and other matters. Ken has litigated cases in the State Courts of California and New York, United States District Courts in the Southern, Central and Northern Districts of California, the Southern and Eastern Districts of New York, the Southern and Middle Districts of Florida, the District of Columbia, the Northern District of Illinois, the Eastern District of North Carolina, and the Western District of Missouri and the United States Courts of Appeal for the Second and Ninth Circuits. Administratively, Ken regularly litigates matters before the Trademark Trial and Appeal Board (TTAB) of the US Trademark Office, and has represented clients at the United States International Trade Commission and worked with the National Intellectual Property Rights Coordination Center and Customs and Border Protection of the United States Department of Homeland Security in the seizure of accused products.

Ken also has extensive experience in business transactional matters, including business formations, structuring and financing, asset transfers, real estate transactions and negotiations, high technology acquisitions and due diligence, entertainment transactions and financing and other ventures.

Other Professional Experience

For certain select clients, Ken has acted as General Counsel, managing all of their legal matters in this specialized relationship. These clients have included Fostex Corporation of America, Fostex Research and Development, Inc., The American DJ Group of Companies and BlueStar Global Investors, Inc., a financial services company where Ken was both General Counsel and a Principal.

In addition to acting as Managing Partner for SHERMAN IP, Ken is a serial entrepreneur creating and managing various business entities. These include Quantum Business Solutions Network, Inc., a business consulting and brokerage firm where Ken became a licensed California Broker and was President and CEO overseeing the analysis, marketing and sale transactions of businesses having a net worth less than 20 million dollars, Atilla Pictures/Kenphika Films producing and distributing independent films and Colorado Park Ventures, LLC, a real estate investment entity.

Ken has been a member of numerous state bar organizations, an active USC Alumni, and formerly volunteered as Vice President, General Counsel and a Member of the Board of Directors of Concern Foundation for Cancer Research, a philanthropic organization dedicated to finding and funding cutting edge research seeking a cure for cancer. Ken was also on the Executive Board of the Anti-Defamation League’s Orange County Division where he lead an initiative on cross-cultural outreach programs in the community. Ken has been an instructor at the University of Southern California, School of Engineering where he has taught intellectual property and law related issues. Ken also spends time as a political activist where he undertakes fact finding and works with Members of the United States Congress to develop policies on legislation surrounding US national security.

Get To Know Ken

In his personal time, Ken loves outdoor athletics including scuba diving, sailing, and biking. He’s an avid cross-country mountain biker and has ridden throughout the United States, Latin America, Europe and the Middle East. During the course of his never-ending work week, Ken likes to go for an evening ride by the beach on his road bike, or decompress with a yoga session. But more than anything, Ken’s amazing son and beautiful Labradoodle, Ricki, bring a smile to his face and together they love to explore the parks and trails, and beaches around St. Petersburg, or when they are in town, be found on the hiking trails in Santa Monica where cell phone signals enjoyably don’t reach! When Ken isn’t immersed in firm matters, he can be caught reading historical fiction and thrillers or dreaming of a new destination to ride.
